Terms of Use

Last updated: 2026-10-16

Service provided by [Company Name]. These Terms apply to your use of Daily Journal.

What's new in this version

  • Renamed the paid plan to "Plus". The free tier continues to include journaling, check-ins, habits, and streaks; the paid "Plus" plan adds analytics, AI features, automation, and expanded limits. Prices, billing, renewal, and refund terms are unchanged.
  • Used consistent "accountability" terminology for the accountability contacts and notifications feature.

1. Acceptance of These Terms

These Terms of Use ("Terms") are a legally binding agreement between you and [Company Name] (the provider of Daily Journal, referred to as "we," "us," or "our") governing your access to and use of Daily Journal (the "Service"). By creating an account, checking the acceptance box during registration, or otherwise accessing or using the Service, you agree to be bound by these Terms and to the collection and use of your information as described in our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and Your Account

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information and to notify us of any unauthorized use of your account. You may not share your account credentials or allow others to access your account.

3. Description of the Service

Daily Journal is a personal journaling and self-reflection tool that lets you record daily entries, track habits, emotions, and recovery-oriented reflections (including the Faster Scale), set weekly commitments and reflect on them, and optionally share non-clinical check-in alerts with contacts you designate. Some features rely on artificial intelligence to analyze journal information and generate summaries, insights, and check-in suggestions. Some of this processing may run automatically based on the Service's feature rules after you record the relevant data. The Service also includes a group-leader referral program. If you register through a group leader's invite link, you become part of that leader's group, and the group leader may earn referral credits based on your paid subscription periods, as described in Section 9. If you choose to enable it, a limited set of your information: your weekly insight and your latest journal status, may be shared with your group leader, as described in Section 9 and the Privacy Policy. Such sharing is optional, off by default, and under your control at all times. The Service relies on third-party providers for certain functionality, including hosting, database services, email delivery, payment processing, analytics, and artificial intelligence. The availability of certain Service features may depend on these providers. We are not responsible for outages or failures caused by third-party services outside our reasonable control.

4. Not Medical, Mental-Health, or Crisis Services: No Professional Advice

Daily Journal is a self-reflection and journaling tool. It is not a medical, mental-health, clinical, or crisis service, and it does not provide professional medical, psychological, psychiatric, or addiction-treatment advice, diagnosis, or care. Content in the app, including the Faster Scale and any related content, reflects your own self-reported reflections and is provided for informational and personal-growth purposes only. If you have a health, mental-health, or substance-use concern, consult a qualified professional. If you are in immediate danger or in crisis, contact a local crisis line or your local emergency services.

5. AI-Generated Content Disclaimer

Some content in Daily Journal is generated by artificial intelligence and is provided for reflection and encouragement only. AI-generated content can be inaccurate, incomplete, or misleading, and it is not professional medical, mental-health, clinical, or spiritual-care advice. Carefully evaluate any suggestions before acting on them, and do not rely on AI content in place of advice from a qualified professional. AI features receive only the information relevant to the particular feature and may not be aware of other content you have recorded, so their output may be based on incomplete information. You acknowledge that AI-generated summaries and suggestions may not always reflect your situation accurately and that you are solely responsible for how you use or rely on them.

6. Accountability Contacts and Notifications

Accountability notifications are based only on information you self-report in your journal, and they are sent through email, which can be delayed, misdirected, or fail to deliver. Your accountability contacts are not medical professionals and may be unavailable. This feature is a supportive reminder. It is not a medical alert, monitoring, or emergency service, and it must never be relied on to obtain urgent help. If you are in crisis or immediate danger, contact a local crisis line or your local emergency services directly. Daily Journal does not monitor journal entries continuously and does not guarantee that an accountability notification will be generated, sent, received, or acted upon. You are responsible for ensuring your accountability contacts have consented to receiving notifications, that their contact information is accurate, and for reviewing and maintaining the notification filters you configure. You acknowledge that we cannot guarantee the receipt, timing, or delivery of any notification.

7. Your Content and Your Responsibilities

You own the journal content, blog posts, habits, commitments, and other data you create ("Your Content"). You grant us a limited, non-exclusive, worldwide license to store, process, reproduce, and transmit Your Content solely as necessary to provide, maintain, secure, and operate the Service and its features, including processing by our service providers (such as AI, email, and hosting providers) as described in the Privacy Policy. When you enable "Leader visibility" in your settings, you also agree that your group leader may view your current weekly insight and your most recent journal status (including your recorded emotion, Faster Scale level, goal, and, where applicable, the associated journal text), strictly as made visible to them within the Service. You can disable this sharing at any time, as described in Section 9. You agree that Your Content will not violate any law or the rights of any third party. You are responsible for the accuracy and truthfulness of what you record and for how you use information you receive through the Service.

8. Subscriptions, Billing, and Refunds

The Service is offered on a free tier and a paid "Plus" subscription basis, and the features available depend on your plan. New accounts currently receive a seven-day free trial with access to Plus features; the trial does not require payment information. When the trial ends, Plus features will no longer be available unless you subscribe to a paid plan. Plus features are billed on the cycle you select at checkout, through our payment processor (Stripe), and may be subject to applicable taxes. Subscriptions renew automatically unless canceled before the renewal date; the applicable price and renewal period will be shown before you complete your subscription. You can manage or cancel your subscription in your account or through the payment processor. Canceling a subscription prevents future renewals but generally does not result in a refund for the current billing period. Fees are non-refundable except where required by law. We may change pricing or features periodically, with reasonable notice where practicable.

9. Group Leaders, Referral Program, and Optional Sharing

Group leaders are users who invite others to the Service through a personal referral link. If you create an account using a group leader's referral link, you become part of that leader's group, and the group leader may be credited with referral earnings based on your paid subscription periods, as described in the Service and the Privacy Policy. Referral credits are provided at our discretion, may be subject to conditions , including reasonable anti-fraud controls, and are not legal tender. We may modify, suspend, or terminate the referral program at any time, with or without notice. Sharing information with your group leader is entirely optional and off by default. If you enable "Leader visibility" in your settings, your group leader can see your display name or email address, your plan status, your current weekly insight, and your most recent journal status. Your leader does not receive access to your full journal history and cannot edit or comment on your content. You may turn sharing off at any time from your settings; once disabled, the leader will no longer be able to access that information through the Service. If you are a group leader, you are responsible for the appropriate and lawful use of any member information you can access through the Service. You agree to respect members' privacy and not to share, re-disclose, or use their content or personal information outside of what is permitted by these Terms and the Privacy Policy.

10. Intended Use and No Guarantee of Results

The Service is offered "as is" for your personal reflection and growth. We do not promise or guarantee any particular outcome, including but not limited to recovery, sobriety, habit change, or emotional improvement. Your results depend on your own effort and circumstances. You should never delay or avoid seeking professional care because of something you read in the Service.

11. Acceptable Use

You agree not to: use the Service unlawfully or to harass, threaten, or harm others; attempt to access another user's account or data; interfere with or disrupt the Service, its servers, or networks; scrape, reverse-engineer, or copy the Service beyond normal use; upload malicious code; or resell or sublicense access to the Service without our prior written consent. Emails sent through the Service to your accountability contacts must be used in good faith.

12. Intellectual Property

The Service, including its software, design, logos, branding, and all non-user-generated content, is owned by [Company Name] or its licensors and is protected by applicable copyright, trademark, and other laws. Except for Your Content, you receive no ownership rights in the Service. We grant you a limited, revocable, non-transferable license to use the Service for your personal, non-commercial use.

13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT (INCLUDING AI-GENERATED CONTENT) WILL BE ACCURATE OR COMPLETE. We do not guarantee that the Service will be uninterrupted or error-free, or that it will achieve any particular result for your recovery journey.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL ACHIEVE ANY PARTICULAR RESULT FOR YOUR RECOVERY JOURNEY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL [Company Name], ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. Termination

You may delete your account at any time from the Service settings, which initiates deletion of your account and associated data as described in the Privacy Policy. We may suspend or terminate your access to the Service, in whole or in part, if we reasonably believe you have violated these Terms, or for any lawful reason, with or without notice. Sections that by their nature should survive termination, including provisions about disclaimers, limitation of liability, governing law, and dispute resolution, will survive.

16. Dispute Resolution

If you have a dispute with us, we encourage you to contact us first at [contact email] so we can try to resolve it directly. If we cannot resolve the dispute informally within thirty (30) days of your notice, both parties agree to resolve any claims through binding arbitration on an individual basis rather than in court. You waive the right to participate in class action lawsuits or class-wide arbitration, and claims will not be consolidated with those of any other person. Any arbitration will be conducted under the rules of the American Arbitration Association then in effect. This Section survives termination of your account and applies to the fullest extent permitted by law.

17. Governing Law

These Terms are governed by the laws of the United States, without regard to its conflict-of-laws principles. Some jurisdictions impose mandatory local consumer protections; nothing in these Terms limits your rights under applicable mandatory local law.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date below and, where practical, notify you in the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

19. Contact

Questions about these Terms, the Privacy Policy, or the Service may be directed to us at [contact email].

20. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and [Company Name] regarding the Service. If any provision is found to be unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision.
